Plaintiff Receives $48,765 for Soft Tissue Injuries - Foo v. Masardijian

The Plaintiff was involved in a motor vehicle accident on April 27, 1999.  He was rear-ended by the Defendant while driving over the Port Mann Bridge. 

The Judge characterized this as an unusual trial and found that the Plaintiff had a non-medical sense of paranoia in relation to the Defendant's insurer.  The Plaintiff represented himself at the trial of this matter. 

The Plaintiff had numerous pre-existing medical difficulties, which made the assessment of his claim more difficult.  Ultimately, it was concluded that the Plaintiff suffered soft tissue injuries to his neck, lower back, forearms, wrists, and ankles, and bruising to his chest.  This developed into a form of a chronic pain condition that caused him to continue experience pain which was disabling for not more than 18 months after the accident.

9,800 Collisions Between Motor Vehicles and Animals Per Year

ICBC reports an annual average of 9,800 collisions between motor vehicles and animals over the past 5 years.  A recent report from the transportation ministry indicates that 5,600 wild animals were killed on provincial highways alone last year (the remaining collisions occur on non-provincial highways).  Of these collisions, more than 4,400 involve deer. 

The Ministry of Transportation erects signage in particularly dangerous areas.  It is also reported that dawn and dusk are the most risky times for collisions due to increased movement of animals.  The spring and fall seasons are also periods of increased collisions due to the migration of wildlife.  The Ministry of Transportation recommends taking extra caution and reducing speeds in areas where there are warning signs for wildlife.

Plaintiff Awarded $78,387.86 for Injured Back and Knee - Hill v. Durham

This matter relates to a motor vehicle accident which took place on December 27, 2005. 

 

The Plaintiff suffered a back injury which resulted in significant pain for six months following the accident.  The pain settled down over the following two years, however it remains significantly limiting. 

 

The Court found that the Plaintiff suffered a moderate soft tissue injury to her back which remained problematic four years after the accident.  The Plaintiff also suffered from pain in her knee. 

 

The Plaintiff was awarded the following:

 

             Non-Pecuniary Damages                     $40,000.00
